Q: What is a guardian?

A: A guardian is an individual who has the responsibility of making decisions on behalf of another who has become disabled or otherwise incapacitated or incompetent.  If you do not have a Durable Power of Attorney in place and you become incompetent to make important decisions regarding your physical or mental health, it may be necessary to apply to the court to have a guardian appointed to make these decisions for you.
