Q: Can I avoid serving jail time for a DUI in Pinellas County if I get alcohol treatment ?

A: Yes, it is possible but it is at the court’s discretion.  Florida Statute 316.193 gives the judge discretion to allow a person to serve all or any portion of incarceration in a residential alcoholism treatment program or residential drug abuse treatment program.  The time spent in the program is given as as jail credit for the number of days in the residential program.
